Storage Services

Storage services will include the pickup, transportation, storage, and delivery of the customer’s possessions. The Customer will present pre-packed personal items to USC Storage at the time of pickup. USC Storage will transport these goods to an appropriate storage facility chosen at the sole discretion of USC Storage. USC Storage will return the goods to the Customer during dates and times established by USC Storage by considering school and dormitory schedules. The Customer will agree to be present to receive the goods at the specified delivery date, time, and location unless early deliveries are arranged by USC Storage and the Customer. The Customer understands that access to goods in storage is permitted only with 7 days prior notice and upon payment of a non-refundable fee for access (as per the Pricing section). USC Storage will not store or ship packages containing liquids and the Customer will be liable for any damage their storage contents may inflict on the property of others. Changes to the previously scheduled delivery date or location must be communicated by the Customer to USC Storage at least 14 days prior to the earlier of the originally scheduled delivery date and the new delivery date. Changes made within 14 days of delivery are not guaranteed. An additional fee may be assessed as per the Pricing section.

Supply Distribution

USC Storage will make available boxes and other packing supplies approximately one week prior to the commencement of the school move out week. USC Storage will notify the Customer in advance of the dates, times, and locations where the supplies can be obtained. It is the responsibility of the Customer to make arrangements to pick up the supplies during the times specified. While USC Storage will use its best efforts, it does not guarantee that adequate supplies will be available to meet the Customer’s needs. Though boxes are free of charge, customers taking excess boxes may be charged an extra fee.

USC Storage’s Right to Access Belongings

We may open any of your boxes without providing you with any prior notice in cases of emergency, which would include, but is not limited to, situations when, in our discretion, we need to: (i) make any repairs to the box or replace the box (however we are not obligated to repair or replace any boxes); (ii) locate and remove any property which appears to be seeping out of the box, or which appears to be emitting fumes or odors from the box, or which appears to be harming or endangering any other box or the property of any others; (iii) enforce the terms of this Agreement, including all our rights and remedies; (iv) open the box for security reasons generally; or (v) comply with any Court Order or applicable law or regulation. At all other times, we will provide you with reasonable notice prior to opening a box containing your belongings.

Abandonment

The Customer agrees that their failure to be present on the scheduled delivery day and their failure to communicate with USC Storage concerning an alternate delivery arrangement constitutes abandonment of their stored possessions. In the case of abandonment of their possessions, the Customer agrees to pay USC Storage for all charges and fees relating to the failed delivery and further shipping of the possessions to the permanent address provided by the Customer. USC Storage has the right to assume ownership of the abandoned property on December 30th of the service year.

Shipping Services

USC Storage shall act only as an intermediary for the receipt and forwarding of the Customer’s shipping items to the USC Storage-designated shipping carrier (“Carrier”). USC Storage will pick up and transport the shipping items to the Carrier. The Carrier will deliver the items to the address specified on the shipping labels approximately 10 business days after their pickup.

Comprehensive Insurance Policy

USC Storage insures all items released to our service for their full value not exceeding $150 dollars per container or $100 dollars if item is stored alone (as in the case of furniture, separately packed electronics, etc.) unless the customer declares all items worth more than $100 US when the items are picked up, and will accept responsibility for damages resulting during transportation and storage except in the following cases:

  • Electronic equipment not packed in its original packaging or packaging provided by a professional packing service (for example, monitors, computers, stereo equipment, televisions, and all other electronic equipment)
  • Jewelry, coins or collectables
  • Cash
  • Damaged or broken items without evidence of physical damage to the packaging container
  • Items of sentimental or intangible value
  • Extremely fragile items (for example, mirrors)
  • Improperly Packed Items (items not adhering to our packing tips and regulations)
  • Unpacked Items (for example, furniture that is not wrapped and protected)
  • Damages caused to particleboard and assembled furniture
  • Minor damage resulted from normal moving and handling (for example, nicks, scratches, cuts, and scrapes)
  • Damage to storage containers (for example, trunks, boxes, plastic bins, and all other storage containers)
  • Any illegal substance or paraphernalia used in conjunction
  • Guns, knives, and all other weapons
  • Damage due to earthquake, tornado, fire, flood, or war or damages occurring while the items are not in the possession of USC Storage
  • Any items not declared will be insured for up to but not exceeding $150 dollars per container or $100 dollars if item is stored alone (as in the case of furniture, separately packed electronics, furniture, etc.)

Unless agreed upon beforehand, each item must be claimed within 30 days of the final delivery of the season. If it is not, a penalty will be assessed. This penalty is equal to the cost of summer storage of the item. If the item is not claimed within 30 days of the final delivery of the season, USC Storage will receive ownership of said item(s). The 30-day storage penalty must still be paid even if items are claimed by USC Storage. USC Storage makes every effort to store belongings at a constant room temperature and in any event mold/mildew may still persist. The Company is in no way liable for any damage that may occur due to mold or inadequate ventilation.

Insurance Claim Process and Forms

If a valid insurance claim is filed, USC Storage will be liable for the lowest value of the following three possibilities:

-The cost of restoring the property to the condition it was in immediately before the move
-Actual replacement value of property
-The verified purchase price less depreciation

In order to complete a valid insurance claim, a customer must:
Complete and submit the insurance claim form within 14 days of delivery or attempted delivery of item.
Keep all packaging materials and damaged items, both of which should not be tampered with after the discovery of a damaged item.
USC Storage reserves the right to request a receipt of any lost or damaged item to verify purchase price.
The Customer agrees to first claim any loss with any insurance carried by the Customer or the Customer’s parents, if available. The Customer will make claims against USC Storage only after exhausting other areas of coverage.

Shipping Insurance

USC Storage is not responsible for the insurance of shipped items.
This insurance is provided by the courier for up to and not exceeding $100 US, unless additional insurance is purchased at the time of pickup. It is the customers responsibility to request this additional insurance and declare any items exceeding $100 US (shipping insurance does not increase by simply declaring the item’s value as it does with storage). Any terms for our shipment of goods via our shipping provider can be found at their Web site www.ups.com.

Limitation on Liability:

YOU HAVE FULL RESPONSIBILITY FOR, AND BEAR ALL RISK OF LOSS OR DAMAGE TO THE BOXES AND THEIR CONTENTS, AND FOR ANY DAMAGE CAUSED TO YOUR PROPERTY OR TO THE PROPERTY OF OTHERS BY THE BOXES OR BY THEIR CONTENTS WHILE THE BOXES REMAIN IN YOUR POSSESSION, INCLUDING WHILE THE BOXES ARE ON YOUR DRIVEWAY OR LOADING DOCK, OR IN ANY HALLWAY OR ANY OTHER COMMON AREA OF YOUR RESIDENCE. SUBJECT TO THE SECTION ENTITLED INSURANCE, FOLLOWING PICK-UP OF YOUR BOXES FROM YOUR RESIDENCE UNTIL THE BOXES ARE DELIVERED TO YOU, USC STORAGE DOES NOT ASSUME ANY RISK FOR LOSS OR DAMAGE TO THE PERSONAL PROPERTY YOU HAVE PLACED IN THE BOXES FOR STORAGE, NO MATTER HOW THE LOSS OR DAMAGE MAY BE CAUSED, EXCEPT FOR LOSS OR DAMAGE CAUSED DIRECTLY BY OUR GROSS NEGLIEGNCE OR WILLFUL MISCONDUCT, AND IN ANY EVENT THE COMPANY’S AGGREGATE MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES.

Failure to follow the previously mentioned guidelines will result in complete forfeit of your rights and loss of any insurance. If damage results due to the Customer’s negligence and responsibility to conform to the Terms & Conditions as outlined they will forfeit all rights and will be held financially responsible for all damaged caused to their belongings, the facility, other stored items and any other property owned or cared for by USC Storage.

Customer shall defend, indemnify and hold harmless USC Storage and its employees, agents, affiliates and representatives from and against any and all claims, actions, demands, liabilities, damages, costs and expenses (including, without limitation, reasonable attorneys’ fees), arising out of, in connection with or related to the Services provided under this Agreement or any breach or default by Customer of any agreement, covenant, representation or warranty of Customer under this Agreement By signing/checking below you have fully read, understood and agree to the Terms and Conditions in its entirety. Once signed/checked the Customer is considered in contract with USC Storage and the Student foregoes all their rights as mentioned within The Terms & Conditions.

Governing Law: The laws of the State of California shall govern this Agreement, without regard for conflicts of law.
